The Declaration of Covenants, Conditions and Restrictions (DCCRs), signed and recorded on August 9, 2022, is the governing document for your Homeowners Association (HOA).
The DCCRs govern the real estate and are recorded with the Recorder of Deeds as a legally binding document. These restrictions are meant to maintain property values so are written with that in mind.
They may be changed, modified or amended at any time by written covenant signed by the Owners of Two Thirds (2/3) of the Lots in the subdivision. Any amendments must be recorded with the Recorder of Deeds.
There are thirty (30) Lots; therefore, the DCCRs may be amended by a vote in the affirmative by Twenty (20) Lot Owners.
Bylaws can be created/written by the Board of Trustees and may be amended by two thirds (2/3) of the Board; two (2) Trustees, at any time. Your HOA does NOT currently have Bylaws; only DCCRs.
A Violation Enforcement Policy was adopted by a majority of the Board of Trustees at the Board Meeting held on 07/11/2023 and is attached.
